These Terms of Service govern use of the On The Rise Projects website, estimate-request process, and other preliminary communications with us. They do not replace the written home improvement contract required for an accepted renovation or construction project.
1. Website and Inquiry Use
This website provides general information about On The Rise Projects and allows prospective clients to request estimates, walkthroughs, and information. Submitting an inquiry does not create a contractor-client relationship, reserve a project date, or obligate either party to proceed with a project.
2. Estimates and Proposals
Website descriptions, preliminary discussions, and estimates are provided for planning and evaluation. Unless expressly stated otherwise in a signed written agreement, an estimate is not a final contract or guarantee of final project cost. Pricing, scope, availability, and scheduling may change when site conditions, measurements, selections, permit or building requirements, concealed conditions, or requested work are confirmed.
3. Home Improvement Contract
No home improvement work will begin solely because a website form, estimate, proposal, or selection document has been submitted or accepted. Before covered work begins, the parties will execute the written home improvement contract and related documents required for the project. The signed project contract controls the scope of work, contract price, payment schedule, start and completion terms, warranties, cancellation rights, change orders, and other project-specific obligations. If these website Terms conflict with a signed project contract, the signed project contract controls for that project.
4. Deposits and Payments
Any deposit, progress payment, final payment, financing arrangement, or payment schedule will be stated in the applicable written project contract or invoice and is subject to applicable law. Website submission alone does not authorize a charge. Clients are responsible for making payments according to the signed agreement.
5. Changes and Additional Work
Changes to an agreed project scope, including additions, substitutions, upgrades, owner-requested revisions, or work made necessary by conditions discovered after work begins, may affect price and schedule. Project changes will be handled through the written contract and, where applicable, written change orders or other written authorization.
6. Scheduling and Delays
Proposed dates are subject to confirmation in the written project agreement. Project timing may be affected by building access, client selections, permits or approvals, inspections, material availability, concealed conditions, weather, utility interruptions, subcontractor or supplier availability, and other circumstances addressed in the applicable project contract.
7. Client Responsibilities
Clients are responsible for providing accurate project and property information, lawful access to the premises, timely selections and approvals, and information concerning building, condominium, cooperative, landlord, or other property requirements that may affect the work. Additional responsibilities may be stated in the signed project contract.
8. Permits, Approvals, and Third Parties
Where permits, building approvals, certificates of insurance, architects, engineers, specialty trades, or other third-party services are required, responsibility and cost will be identified in the applicable proposal or contract. On The Rise Projects does not guarantee approval by a government agency, building, board, lender, insurer, or other third party.
9. Warranties
Any workmanship, manufacturer, material, or other warranty applicable to a project will be stated in the signed project contract or provided by the applicable manufacturer or supplier. Nothing in these Terms limits rights or warranties that cannot lawfully be waived.
10. Website Content
Photographs, descriptions, project examples, pricing examples, timelines, and other website content are illustrative unless expressly identified as applying to a particular signed project. Actual results, materials, layouts, costs, and schedules vary by property and scope.
11. Intellectual Property
Unless otherwise indicated, the website design, branding, text, graphics, and original content are owned by or licensed to On The Rise Projects and may not be copied, reproduced, or commercially used without permission, except as permitted by law.
12. Privacy
Information submitted through this website is handled as described in our Privacy Policy.
13. No Waiver of Consumer Rights
These Terms are intended to supplement, not waive, rights and protections provided by applicable federal, New York State, or New York City law. Nothing in these Terms eliminates any mandatory notice, cancellation right, warranty, remedy, or other protection that cannot legally be waived.
14. Changes to These Terms
We may update these website Terms from time to time. The “Last updated” date above identifies the latest revision. Changes apply prospectively to use of the website and do not modify an existing signed project contract unless the parties agree in writing.
